Withdrawal Policy
Information about your right of withdrawal for digital content
Last updated: April 4, 2026
Important: Digital Content & Services Exception
For digital content (such as e-books and downloadable PDFs) and digital services (such as data dashboard subscriptions), special rules apply. Please read this policy carefully before purchasing.
1. Right of Withdrawal
Standard Withdrawal Right
As a consumer, you generally have the right to withdraw from a distance contract within 14 days without giving any reason.
The withdrawal period expires 14 days from the day on which the contract is concluded.
To exercise the right of withdrawal, you must inform us of your decision to withdraw from the contract by an unequivocal statement (e.g., a letter sent by post or email). You may use the model withdrawal form below, but it is not obligatory.
2. Exception for Digital Content
Loss of Withdrawal Right
You lose your right of withdrawal for contracts for the supply of digital content not supplied on a tangible medium (e.g., downloadable PDF files) if:
- You have given your prior express consent to begin the performance (delivery of the digital content), AND
- You have acknowledged that you thereby lose your right of withdrawal.
This exception is based on:
- Article 16(m) of Directive 2011/83/EU on consumer rights
- Β§ 356 (5) of the German Civil Code (BGB)
When you purchase a digital product (e.g., our Cape Town travel guide PDF), you are required to check two boxes during checkout:
- Requesting immediate access to the digital content
- Acknowledging that you lose your withdrawal right once the download begins
Once you download the file, your withdrawal right expires. This is because digital content, once downloaded, cannot be "returned" in the traditional sense.
2b. Digital Services (Subscriptions)
For ongoing digital services such as data dashboard subscriptions (crime data access), the following applies under Β§ 356 (4) BGB:
- You have a 14-day withdrawal right from the date the contract is concluded.
- If you consent to immediate access before the withdrawal period expires, and acknowledge the loss of your withdrawal right, the withdrawal right expires once access is provided.
- After the 14-day withdrawal period, you may cancel your subscription at any time for future billing periods. Cancellation does not entitle you to a refund for the current billing period.
To cancel your subscription: Use the cancellation link in your confirmation email, or visit the subscription management page on our website. You may also contact us at info@capetowndata.com.
This is based on:
- Β§ 356 (4) of the German Civil Code (BGB) β digital services
- Β§ 312k BGB β right to online cancellation
3. Effects of Withdrawal
If you withdraw before downloading: We will reimburse all payments received from you without undue delay and at the latest within 14 days from the day on which we are informed of your decision to withdraw. We will use the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise.
If you have already downloaded the content: Withdrawal is no longer possible as explained in Section 2 above.
